What is a Partner Visa?
Basically, a Partner Visa enables the partner of an Australian citizen or permanent resident to stay in Australia. There are two categories: Prospective Marriage visa and Partner Visa. These categories differ based on the type of relationship you are in. A Prospective Marriage visa applies to couples intending to get married while the Partner Visa applies to married couples or those in a de facto relationship.
A Partner Visa involves two stages. The first stage entitles you to a Temporary Partner (subclass 820 or 309) visa which allows you to live in Australia. Once you reach two years under the Temporary Partner Visa, you may be eligible to apply for the second stage which is the Permanent Partner Visa (subclass 801 or 100) stage which grants you permanent residency status.
Eligibility Criteria
An applicant for the Prospective Marriage (300) visa must have met, known and intend to marry their prospective spouse. The applicant must also be at least 18 years of age.
An applicant for the Partner Visa must either be married or in a de-facto relationship with an Australian citizen or permanent resident. The marriage must be valid under Australian law. If in a de-facto relationship, the relationship must be proven to be at least 12 months. However, the 12-month requirement may be waived in certain circumstances. For more details, click here.
